Terms of Service

These Terms of Service ("Terms") govern your use of the Cadence application ("Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Cadence is operated by Brahim Zeqiraj as an independent developer based in the European Union.

1. The Service
Cadence is an AI-powered music recommendation application that personalizes listening experiences by integrating with third-party music streaming services (Spotify) and, optionally, biosignal services (WHOOP).
The Service is currently in private beta. Features may change, break, or be removed at any time. We make no guarantees about availability, performance, or specific functionality.
2. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. By using Cadence, you represent that you meet this requirement.
3. Your Account
- You are responsible for maintaining the confidentiality of your account.
- You are responsible for all activity under your account.
- You agree to provide accurate information when creating your account.
- You may delete your account at any time via Settings → Account, or by emailing us. Account deletion removes your data per our Privacy Policy.
4. Third-Party Services
Cadence integrates with third-party services. Your use of those services is governed by their own terms and privacy policies:

- WHOOP — WHOOP Terms
You are responsible for maintaining the third-party accounts you connect. We do not control these services and cannot guarantee their availability or behavior.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose.
- Attempt to reverse-engineer, decompile, or extract source code or models.
- Resell, sublicense, or redistribute the Service.
- Interfere with the operation of the Service or attempt to gain unauthorized access to systems.
- Use the Service to violate any third-party rights, including intellectual property and privacy rights.
- Use the Service to circumvent any third-party service's terms (for example, using Cadence to bypass Spotify's account limits).
6. Music Content
Cadence does not host, distribute, or stream music. All music playback occurs through your connected third-party services (e.g., Spotify) on devices you control. Your access to music content is governed by those services' own terms.
We make no representations about the availability of any specific track or artist.
7. Intellectual Property
The Cadence application, name, branding, design, and underlying software are owned by Brahim Zeqiraj. Nothing in these Terms grants you a license to use the Cadence brand or software outside of the Service itself.
You retain all rights to your personal data. You grant us a limited license to process that data solely to operate and improve the Service, as described in our Privacy Policy.
8. Beta Status and Disclaimer
The Service is provided "as is" and "as available" during the private beta. We disclaim, to the maximum extent permitted by law:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties about the accuracy, reliability, or completeness of any recommendations or biosignal interpretations.
Cadence is not a medical device. Recovery scores, heart rate readings, sleep data, and any inferences drawn from them are for entertainment and personal-interest purposes only. Do not rely on Cadence for medical or health decisions.
9. Limitation of Liability
To the maximum extent permitted by law, in no event will Cadence be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.
Our total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim — which, during the beta, is zero (the Service is free).
This section does not limit liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.
You may stop using the Service at any time by deleting your account.
Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, governing law) will continue to apply.
11. Changes to These Terms
We may update these Terms from time to time. We will post any updates here and update the "Last updated" date. Material changes will be communicated by email if you have an account. Continued use after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of Germany, without regard to its conflict-of-law principles. Any disputes will be resolved in the courts of Germany, except where mandatory consumer protection laws of your jurisdiction provide otherwise.

These terms are provided in good faith for a personal-use developer project in private beta. They are not a substitute for legal advice. As Cadence grows beyond beta, these terms will be reviewed by qualified counsel.
